Terms and Conditions of Sale & Service

1. Definitions

The Company: 118 Print & Design Limited (Company No: 7548678).

Registered Office: Unit 12 Birch House, Birch Lane Business Park, Aldridge, WS9 0NF.

Partner Data Entity: Market Location (Company No: 01434650), used for the securemanagement and hosting of specific marketing data.

Customer: Any business, organisation, or individual acting on behalf of a business purchasing goods or services.

Specials: Bespoke, personalised, or non-mainline catalogue products (including all printed matter) which are non-returnable.

2. General Terms

By using "The Website" or engaging in a trade agreement with The Company, you agree to these Terms and our Privacy Policy.

Errors: The Company is not liable for typographical or clerical errors on the website or sales literature.

Availability: We strive for 100% website uptime but cannot guarantee uninterrupted access due to the nature of the Internet.

3. Data & Marketing

Your data is handled in accordance with the UK GDPR and our Privacy Policy.

Data Management: You acknowledge that certain email marketing data is managed by our Partner Data Entity (Market Location).

Opt-Out: While The Company manages direct sales communications, requests to opt-out of managed marketing lists must be directed to Market Location as specified in our Privacy Policy to ensure permanent removal from their verified database.

4. Selling & Pricing

B2B Only: Orders are accepted only from customers acting on behalf of a business.

Price Fluctuations: Due to currency exchange and manufacturer changes, prices are subject to change without notice.

Prices quoted are exclusive of VAT.

RRP: Manufacturer’s Recommended Retail Prices are for guidance only and may not reflect The Company’s selling price.

5. Deliveries

Mainland Britain: We aim for next-working-day delivery (by 5:30 PM) for standard orders. This excludes the Scottish Highlands and offshore islands.

Discrepancies: Following delivery, the Customer must notify The Company of any shortages or discrepancies within 3 working days. After this period, the order is deemed complete.

6. Payment Terms

Credit Accounts: Payment is due 30 days from the tax point (invoice date).

Late Payment: The Company reserves the right to take legal action to recover debts. Interest will be charged at 8% above the Bank of England base rate per annum (pursuant to the Late Payment of Commercial Debts Act 1998) plus all legal recovery costs.

7. Risk, Title & Warranty

Title of Goods: Legal ownership (Title) of goods does not pass to the Customer until The Company has received payment in full. Risk passes to the Customer upon delivery.

Warranty: We guarantee workmanship for 30 days. This does not cover willful damage, negligence, or failure to follow instructions.

Limited Liability: The Company’s liability is limited to the repair or replacement of goods or a refund of the purchase price. We are not liable for consequential loss or loss of profit.

8. Returns

Unprinted/Stock Items: May only be returned with prior written agreement and may be subject to a restocking fee.

Specials: Bespoke or printed products cannot be returned under any circumstances unless found to be defective at the time of delivery.

9. Jurisdiction

These terms are governed by the laws of England and Wales. Any disputes shall be subjectto the exclusive jurisdiction of the English courts.
